What Are Legal Motions?

A legal motion is a request or proposal directed at the court to avail a party of a desired ruling or order. Depending on the court's rules, a motion could be written or oral. However, most motions are usually required to be written. While parties to action might file several motions while a dispute is before the court, the motion can only be valid if it is filed after the initial complaint.

Motions are an essential part of litigation because they are one of the methods through which you can make requests from the court, as the court will never grant what you do not ask. There are different motions depending on the type of case and the request you intend to make. Motion for summary judgment is the most common type of motion because it asks the court to rule on a matter before parties go to trial.

Previously, John Biernat served as a police officer with the Harper Woods Police Department in Harper Woods, Michigan. He is a recipient of the Public Safety Officer Medal of Valor in 2012.

The Public Safety Officer Medal of Valor was created according to The Public Safety Officer Medal of Valor Act of 2001. The law was passed by the US Congress to honor the commitment of public safety officers who risk their life and limb to protect America’s citizens and communities. The Public Safety Officer Medal of Valor is the highest national award to recognize public safety officers’ valor. Every year, the President presents the award to the recipients in a ceremony called for the purpose.

The Public Safety Officer Medal of Valor is given to a living or a deceased public safety officer who has demonstrated acts of valor above and beyond the call of duty. The act of bravery showed “exceptional courage, extraordinary decisiveness, presence of mind, and unusual swiftness in action” in an attempt to protect or save human life without regard to personal life or safety.

Under The Public Safety Officer Medal of Valor Act of 2001, a public safety officer may be a law enforcement officer, a firefighter, a court, civil defense, corrections officer, or an emergency services officer who has served or is serving a public agency with or without compensation.
